English summary: Since the end of the last decade, the precautionary principle has become the central principle of European health and environmental protection law. The principle justifies and demands the adoption of protective measures in situations of uncertainty as to the existence or extent of risks to human health and the environment. The study analyzes the scope of this principle in European Union law. Birger Arndt first outlines the status and the meaning of the precautionary principle in the member states. In the main part of the work, he analyzes the development, meaning, scope of application, functions and preconditions of the principle in European Union law. In conclusion, he outlines the limits established by WTO law to risk management in European health and environmental law and the influence it has on the definition and scope of the precautionary principle.


German description: Das Vorsorgeprinzip hat sich seit Ende der 1990er Jahre zu dem Rechtsgrundsatz des gemeinschaftlichen Risikoverwaltungsrechts entwickelt. Es legitimiert und fordert praventives Handeln in Situationen, in denen aufgrund von wissenschaftlichen oder technischen Kenntnisdefiziten Unsicherheit uber das Vorliegen von Risiken und deren Ausmass fur Mensch und Umwelt besteht. Dabei stellt sich die Frage, welche genaue Ausgestaltung der Grundsatz im Gemeinschaftsrecht erfahren hat.Birger Arndt gibt zunachst einen Uberblick uber Bedeutung und Status des Vorsorgeprinzips im Recht der Mitgliedstaaten. Im Hauptteil untersucht er Entwicklung, Bedeutung, Anwendungsbereich, Funktionen und Voraussetzungen des Grundsatzes im Recht der Europaischen Union. Abschliessend skizziert der Autor die WTO-rechtlichen Grenzen und Einflusse auf das gemeinschaftliche Risikoverwaltungsrecht und die Reichweite des Prinzips.Das Buch wurde mit dem Umweltpreis 2009 der Gesellschaft fur Umweltrecht ausgezeichnet.
