Complicity in International Law

Complicity in International Law

Author: Dimitris Liakopoulos Format: Hardback Release Date: 30/09/2020

Complicity in International Law aims to analyze questions arising from a state's complicity in conflict with another state or an international organization. On the basis of international legal provisions, a state that assists the illicit fact of another state or an international organization in turn commits an offense if it is aware of the main fact and is bound by the same obligation. International law offers adumbrates the outcome of a codification process undertaken by the International Law Commission. The practice and its consequences, and the reflections of the doctrine, have matured with regard to the original hypothesis. Several cases of participation in the unlawful conduct of others, for example in facilitating the illicit use of the armed force, or of financial support to states responsible for human rights violations, have been recorded since the period immediately following World War II. International doctrine has long shown great interest in the theme of competition of several subjects in an international illicit act. This is a new phenomenon, given that until recently the issue had been the subject of in-depth analysis in a small number of works, few of which have been monographic in nature. Complicity in International Law will address the issue comprehensively.

Agreement on the International Carriage of Perishable Foodstuffs and on the Special Equipment to be Used for Such Carriage

Agreement on the International Carriage of Perishable Foodstuffs and on the Special Equipment to be Used for Such Carriage

Author: United Nations Economic Commission for Europe, ECE Format: Paperback / softback Release Date: 17/08/2020

The Agreement on the International Carriage of Perishable Foodstuffs and on the Special Equipment to be Used for such Carriage (ATP) is intended to ensure that deep-frozen and chilled foodstuffs are transported efficiently, safely and hygienically and do not pose a danger to human health. It also helps countries avoid the wastage of food through spoilage caused by poor temperature control during carriage. The ATP Agreement provides common standards for temperature-controlled transport equipment such as road vehicles, railway wagons and sea containers (for sea journeys under 150 km) and the tests to ensure the insulating capacity of the equipment and the effectiveness of thermal appliances. New ATP equipment is required to undergo a test of its K coefficient, to prove that the heat escape from the inside to the outside of the body meets the values defined by ATP. All 50 Contracting Parties to the Agreement - including non-UNECE countries (Morocco, Tunisia and Saudi Arabia) - are required to recognize ATP certificates for equipment that conforms to the standards issued by the competent authorities of other Contracting Parties. The ATP lists the products that can be carried under ATP and sets the warmest possible temperature of the load. Fruit and vegetables unless processed are as yet outside the scope of ATP. ATP applies if the point at which the goods are loaded and unloaded are in two different States and the point at which they are unloaded is situated in the territory of a Contracting Party. In other words it applies even if the State where the goods are loaded is not a Contracting Party. Some countries also use the ATP as the basis for their domestic legislation for temperature-controlled transport.

Protection of Legitimate Expectations in Investment Treaty Arbitration

Protection of Legitimate Expectations in Investment Treaty Arbitration

Author: Teerawat Wongkaew Format: Paperback / softback Release Date: 06/08/2020

This book evaluates the core of the concept of legitimate expectations from first principles in moral philosophy. It adopts an unconventional approach by examining this topic from a deep, philosophical perspective and delves into the debates on the binding nature of promise in moral philosophy. It then develops a doctrinal structure for the standard of protection. The author places the key premise of the book on the possibility of deriving firm conclusions from the debate and on creating a set of precise and prescriptive 'guidelines of the application of legitimate expectations'. The features of this book are threefold: first, a significant body of literature on moral philosophy is assimilated; second, core philosophical principles are extracted and expressed as a normative framework to resolve concrete cases; third, the author analysed a vast number of investment treaty awards against the underlying framework.
